LegalChart manages the risk for you by providing your Client with the means to make the medical request through LegalChart and then sharing the medical records with you. A patient/client can share their medical records with whomever they want and the entity or persons receiving the records have no HIPAA obligation with regard to the shared records. There still may be a fiduciary duty of confidentiality but not a HIPAA obligation.
Safe, Reliable, Accessible Storage
LegalChart stores your client’s medical record for three years in a HIPAA compliant cloud environment so you don’t have to store it. The patient will have access to the records for three years via their own personal account. This eliminates the risk of you storing Client’s medical records in a storage unit or other facility that can be accessed or broken in to by a third party. Most storage units require the front office to have a key to be able to access your storage unit which may be a HIPAA violation. We have seen expired credit cards cause storage units to be emptied of patient files including medical records solely based on a clerical error. Typically, these units are sold to the highest bidder.
